Estate & Trust Administration

When a loved one passes away, his or her estate often goes through acourt managed process called probate where the assets of the deceased are managed and distributed. The appropriate length of time for the process depends on the complexity and size of the estate, and the probate court schedule.

The probate process in Massachusetts involves following the strict guidelines of the Massachusetts Uniform Probate Code (MUPC). Based on circumstances, either an informal or formal petition for probate and appointment of personal representative will be filed. We will discuss these alternatives with you to decide which form is best for the estate.

All statutory heirs/devisees will be notified, along with the Massachusetts Estate Recovery Unit, and Veteran’s Association/Attorney General, if required. Once the personal representative is appointed, that person(s) will be tasked with marshalling the assets of the estate and determining outstanding debts. In some circumstances, official appraisals may be required.

Debts of the estate should be taken care of before any distributions are made to heirs/devisees.
